Welcome to Tangcity Academy (“Tangcity Academy”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, training programs, and related services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree to these Terms, you must not access or use our Services.

1. Acceptance of Terms

By creating an account, enrolling in a course, making a payment, or using any part of our Services, you:

• Acknowledge that you have read, understood, and agree to be bound by these Terms.
• Agree to comply with all applicable laws and regulations of the Republic of Indonesia.
• Agree that these Terms form a binding legal agreement between you and Tangcity Academy.

2. Definitions

For the purposes of these Terms:

• “Services” means our website, online and offline training programs, workshops, classes, learning materials, and any other services provided by Tangcity Academy.
• “User”, “you”, or “your” means any individual or entity that accesses or uses our Services.
• “Account” means the user profile you create to access certain features of our Services.
• “Course” means any training, class, or program offered by Tangcity Academy, whether delivered online or in-person.

3. Eligibility and Use of Services

By using our Services, you represent and warrant that:

• You are at least 18 years old, or have obtained consent from a parent or legal guardian if you are under 18.
• You have the legal capacity to enter into a binding agreement.
• You will use the Services only for lawful purposes and in accordance with these Terms.

If you are using the Services on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms, and “you” will refer to that entity.

4. User Accounts

To access certain features of our Services, you may be required to create an Account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your Account information to keep it accurate and complete.
• Maintain the confidentiality of your login credentials and not share them with others.
• Accept responsibility for all activities that occur under your Account.

We reserve the right to refuse registration, suspend, or terminate any Account that violates these Terms or is otherwise deemed inappropriate or fraudulent.

5. Course Enrollment and Payment

5.1 Enrollment

When you enroll in a Course, you agree to complete the registration process, provide accurate information, and comply with any prerequisites or requirements specified in the Course description. Course enrollment is subject to availability and acceptance by Tangcity Academy.

5.2 Fees and Payment

• All fees must be paid in full before you are granted access to Course materials, unless a payment plan has been explicitly agreed.
• Prices are subject to change at any time, but changes will not affect Courses already purchased.
• Accepted payment methods may include bank transfer, credit/debit cards, e-wallets, or other methods specified by us.
• All payments are processed in Indonesian Rupiah (IDR), unless otherwise stated.
• You are responsible for any bank charges, transaction fees, or currency conversion costs.

5.3 Refunds and Cancellations

• Refund requests must be submitted within 7 days of Course enrollment, unless stated otherwise in the Course-specific policy.
• Refunds are generally not available once Course materials have been accessed or the Course has started, except in exceptional circumstances at our discretion.
• Administrative or processing fees may apply to approved refunds.
• Tangcity Academy reserves the right to refuse refunds in cases of policy violations, misconduct, or misuse of Services.

6. Course Access and Content

6.1 Access Rights

Upon successful enrollment and payment, you are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Course content for your personal, non-commercial learning purposes, for the duration specified in the Course description.

6.2 Prohibited Uses

You agree that you will not:

• Share your Account or login credentials with any other person.
• Copy, reproduce, distribute, or publicly display Course materials without our prior written consent.
• Sell, resell, or exploit any portion of the Services or Course content for commercial purposes.
• Use any automated systems (such as bots or scrapers) to access, monitor, or copy content.
• Reverse engineer, decompile, or attempt to extract source code from our platform or systems.
• Use the Services for any illegal, fraudulent, or unauthorized purpose.

7. Certificates and Credentials

Certificates or statements of completion may be awarded upon successful completion of Course requirements, which may include:

• Meeting minimum attendance requirements (e.g., 80% or as specified by the Course).
• Passing required assessments, quizzes, or exams.
• Completing assignments, projects, or practical tasks.

Tangcity Academy reserves the right to determine the assessment criteria and to approve or deny certification at its sole discretion. Misuse, falsification, or fraudulent representation of certificates may result in revocation of the certificate and further legal action.

8. Student Conduct and Classroom Rules

You agree to behave in a respectful and professional manner towards instructors, staff, and other participants, whether in-person or online. Prohibited conduct includes, but is not limited to:

• Harassment, bullying, discrimination, or abusive language of any kind.
• Disruptive behavior that interferes with teaching or other participants’ learning experience.
• Posting, sharing, or displaying content that is offensive, illegal, or inappropriate.
• Impersonating others or providing false or misleading information.
• Bringing prohibited items to in-person classes (such as weapons, illegal substances, etc.).

We may remove you from a Course or terminate your access to the Services, without refund, if you engage in behavior that violates these rules or negatively impacts other participants.

9. Intellectual Property Rights

All content, materials, and features available through our Services—including but not limited to text, graphics, logos, images, videos, audio, course materials, software, and trademarks—are the property of Tangcity Academy or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Except as expressly permitted in these Terms, you may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any part of the Services or content without our prior written consent.

10. Third-Party Services and Links

Our Services may include links to third-party websites, platforms, or services that are not owned or controlled by Tangcity Academy. We are not responsible for the content, policies, or practices of any third-party websites or services.

Your use of third-party services is subject to their own terms and policies, and we encourage you to review them carefully.

11. Privacy

Your use of our Services is also governed by our Privacy Policy , which explains how we collect, use, and protect your personal information. By using our Services, you consent to the collection and use of your information as described in the Privacy Policy.

12. Disclaimer of Warranties

Our Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

While we strive to provide accurate, up-to-date, and high-quality training, we do not warrant that: (a) the Services will meet your specific requirements; (b) the Services will be uninterrupted, timely, secure, or error-free; or (c) any results or outcomes from using the Services will be guaranteed.

13. Limitation of Liability

To the maximum extent permitted by law, Tangcity Academy, its directors, employees, instructors, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with:

• Your access to or use of, or inability to access or use, the Services.
• Any conduct or content of any third party or other users.
• Any content obtained from the Services.
• Unauthorized access, use, or alteration of your transmissions or data.

In any case, our total liability for any claim arising out of or relating to the Services shall not exceed the total amount of fees you paid to Tangcity Academy for the specific Course or Service that gave rise to the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Tangcity Academy and its directors, employees, instructors, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Services; (b) your violation of these Terms; or (c) your violation of any rights of another person or entity.

15. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay is caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, strikes, labor disputes, government actions, pandemics, or interruptions in internet or telecommunications services.

16. Changes to Services and Terms

We may update, modify, or discontinue any part of the Services at any time, with or without notice.

We may also revise these Terms from time to time. When we make material changes, we will post the updated Terms on this page and update the “Last updated” date at the top. Your continued use of the Services after the posting of updated Terms constitutes your acceptance of the changes.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law principles.

Any disputes arising out of or in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Tangerang, Indonesia. Before initiating formal legal proceedings, you agree to first attempt to resolve the dispute informally by contacting us.

18. Miscellaneous

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

These Terms, together with any additional policies or agreements expressly referenced herein, constitute the entire agreement between you and Tangcity Academy regarding the use of the Services.
